MSB Holdings Inc. and our affiliates, subsidiaries and parents (collectively “MSB Holdings,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it though compliance with this Privacy Policy. We collect and process your personal information fairly and lawfully and in order to carry out our lawful business activities. This Policy describes the types of information we may collect from you or that you may provide when you visit our Site (www.rugietmen.com and www.rugiet.com) and any mobile application (collectively, the “Platform”) or use our products, applications, services or content (collectively, including the content and Platform. “Services”), and our practices for collecting, using, maintaining, protecting, sharing and disclosing that information. We also describe the reasonable safeguards we take to protect the security of the information and how to contact us about our privacy practices.

This Privacy Policy is part of and incorporated into the Terms and Conditions, found at Terms and Conditions which is a legally binding agreement between you and MSB Holdings.

Please review this Privacy Policy carefully. If you do not agree with our policies and practices, you may choose not to use our Site or our Services. By accessing and using the Site or our Services, or providing us with personal information, you accept and agree to this Privacy Policy, whether or not you register for an account through the Site.

Residents of Colorado, Delaware, Maryland, Minnesota, New Jersey and Oregon and other states with effective state data privacy laws applicable to MSB Holdings may access the State Privacy Policy and Notice with information and rights required under those states’ respective laws to the extent applicable to the individual consumer by clicking here or scrolling down.

We may update this Privacy Policy at any time, by posting the amended version on this Site including the effective date of the updated version. By accessing the Site after we make such changes to this Privacy Policy, you are deemed to have accepted such changes. We may also provide other privacy notices on specific occasions when we are using your Personal Information so that you are aware of how and why we are using such information and what your rights are with respect to such use.

The Information We Collect About You

What is Personal Information?

For purposes of this Privacy Policy, we refer to Personal Information according tothe following definition: “Personal Information” is any information relating to a natural person who is, or can be, reasonably identified either directly or indirectly from such information and includes information such as a user’s name, address, telephone number, or email address. We collect Personal Information when you register on our Site, use our Services, and when you choose to provide information to us, including through our Site.

In some circumstances, our use of your information will be subject to the requirements of the Health Information Portability and Accountability Act (commonly known as “HIPAA”). For example, when you open an account and submit information regarding a prescription order or seek to connect to a healthcare provider (“Provider”), that information may be subject to HIPAA requirements. In those circumstances, our collection and use of your Protected Health Information (“PHI”) is governed by our contractual agreements with the Provider and any Notices of Privacy Practices used by the Provider that you establish a relationship with. The Providers we contract with are regulated as “covered entities” under HIPAA. Please be aware that this Privacy Policy is distinct from the Providers’ Notice of Privacy Practices, which describes in detail how your PHI is used and disclosed. If you would like to review a copy of the medical practices’ Notice of Privacy Practices, please request a copy directly from your Provider. To the extent that MSB Holdings receives medical information that may be protected under applicable medical information laws, including HIPAA, MSB Holdings and its Affiliates will comply with such laws. To be clear, this information will be used and disclosed only as permitted by HIPAA and applicable state law. The collection and use of your PHI is not governed by this Privacy Policy. By accessing or using our Site or Services, you further understand and agree that any information that is collected about you or you submitted by you that is not for the purpose of diagnosis and treatment by medical providers or laboratories or to fulfill prescription with a pharmacy that we contract with is not considered PHI and will be subject only to our Privacy Policy.

We may collect and otherwise process Personal Information from you in various ways:

  • When you voluntarily provide us with information (e.g., through your communications with us by email, by connecting with us through our social media pages, or by sending us a message or request on our online forms).
  • When you communicate with us concerning our Services.
  • When you place an order with us that does not involve prescription medication.
  • Through automated means when you use our Site or Services including through use of “cookies,” web beacons, pixels and other similar technologies that track your online activity, including your use of our Site.
  • Through information provided by third parties who analyze your usage of our website, such as Google Analytics and advertising providers.
  • Through information provided by service providers providing services on our behalf. We require our service providers who we provide your Personal Information to in order to provide Services to maintain the privacy and security of your Personal Information.

Types of Personal Information We Collect

  • Personal contact information (e.g., name, postal address, email address, and phone number).
  • Demographic information (e.g., date of birth, gender); Physical attributes (e.g., height, weight).
  • Health related information.
  • Lifestyle information (e.g., smoking and drug use).
  • Payment information (e.g., payment card number, expiration date, and billing address).
  • Photographic images submitted for identification or non-diagnosis purposes, including photographs of your driver’s license or passport (in some instances, this may be treated by us as Protected Health Information).

Automated Collection of Personal Information

In addition, when you visit our Site, we and our third party service providers and advertisers may collect certain information by automated means, such as cookies, web beacons, and other tracking technologies.

The information we obtain in this manner includes:

  • IP address; browser characteristics; device characteristics; operating system; referring URLs; geographic location; information on actions taken on our Site; and dates and times of website visits. In certain circumstances, this information may be Personal Information.
  • Cookies. Our Site uses “cookies” and similar technologies. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser.
  • Tracking Technologies, such as Pixels, Beacons. A “web beacon,” also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server. Through these automated collection methods, we obtain “clickstream data,” which is a log of content on which a visitor clicks while browsing a website or the web pages visited.

As you click through the Site, a record of the action may be automatically collected and stored. Your browser may tell you how to be notified when you receive certain types of cookies or how to restrict or disable certain types of cookies. Please note, however, that without certain functional cookies enabled you may not be able to use all of the features of our Site.

Some of our business partners with whom we contract to carry out the Services (e.g., website providers) may use their cookies on our Site. Although we may not have direct access to or control over such cookies, this Privacy Policy governs the use of cookies by us and such business partners on our Site. We may also allow social media companies and advertisers (e.g., Facebook) to put “widgets” and other tracking technologies on our websites. Some internet browsers allow you to limit or disable the use of tracking technologies that collect unidentified information, such as a “Do Not Track” (“DNT”) setting. Currently, we do not respond to DNT signals. As discussed further below, if you have enabled Global Privacy Controls (“GPC”) on your browser, we do recognize GPCs.

How We Use the Personal Information We Collect

MSB Holdings may use the Personal Information we collect for our legitimate business purposes. These purposes include to: create and manage your account; offer and provide information and Services to you; display content on the Site; communicate with you about, and administer your participation in, surveys, events, programs, newsletters, promotions and other Site features; respond to and communicate with you about your inquiries and requests, and provide Services, information, and products you request; send periodic emails to market and promote our products and Services and for non-marketing or administrative purposes; operate, evaluate and improve our business (including developing new products and services; enhance and improve our Services; manage our communications; analyze our products; conduct targeted and cross context behavioral advertising for our products; perform accounting, auditing, billing reconciliation and collection activities and other internal functions); perform data analyses and processing (including market and consumer research, trend analysis, financial analysis, anonymization, encryption and tokenization of personal information); protect against, identify and prevent fraud and other criminal activity, claims and other liabilities; and comply with and enforce applicable legal requirements and our policies. In addition, we may use personal information collected online through cookies, web beacons, tracking technologies and other automated means for purposes such as: (i) customizing our users’ visits to our Site; (ii) delivering content tailored to our users’ interests and the manner in which our users browse our Site; (iii) to market our services to you and (iv) managing our business. We may also use this information to help diagnose technical and service problems, administer our Site, identify users of our Site, and gather demographic information about our users. We may use clickstream data to determine how much time users spend on web pages of our Site, how users navigate through our Site, and how we may tailor our Site to better meet the needs of our users.

Who Do We Disclose or Share Your Personal Information With

We do not sell your Personal Information to third parties. We share your Personal Information with third parties, including third party advertisers, for marketing purposes, including to provide you with targeted advertising or cross context behavioral advertising. We may also disclose your personal information to our service providers who perform services on our behalf. These third parties are not authorized by us to use or disclose the Personal Information except as necessary to perform services on our behalf or comply with legal requirements. Please note that to the extent that this information constitutes Protected Health Information, it is not governed by this Privacy Policy.

We may also disclose the Personal Information we obtain to our affiliates, subsidiaries and partners.

We may disclose Personal Information about you we deem necessary, in our sole discretion, to comply with applicable law or legal process; to law enforcement authorities or other government officials based on a lawful disclosure request; when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity; to defend against legal claims, or when you authorize us to do so. We reserve the right to transfer or use any information we have about you in the event we sell, transfer, or merge all or a portion of our business or assets (including in the event of a reorganization, dissolution, or liquidation).

Aggregate and De-identified Information

We sometimes aggregate or de-identify Personal Information we collect, and the types of systems and browsers of users for internal purposes, so that we may better understand the MSB Holdings and Affiliates user population. Personal Information under this Privacy Policy does not include “aggregate” or “de-identified” information. Aggregate or de-identified information is data we collect about a group of users, from which individual identities have been removed. In other words, information about how you use the Services, or the results of such use, may be collected and combined with similar information from others, but no Personal Information will be included in the resulting aggregate or de-identified data. We can extract statistical data from your content in order to provide it to other users or partners without connecting it to any personal data such as name or email address. Aggregate or de-identified data helps us understand trends and user needs so that we can better consider new products and services, and tailor existing products and services to customer desires. You understand that we may commercialize aggregate or de-identified information by any and all means, and that you will receive no payment or other consideration in respect of such use. In addition, we may share and disclose aggregate or de-identified information for any purpose.

Personal Information Retention

We are subject to multiple laws on the retention of Personal Information and will retain your Personal Information, even if you have closed your account or ceased to be a customer, for as long as is reasonably necessary to comply with our business and legal obligations, meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, or fulfill your request to “unsubscribe” from further messages from us. Similarly, our third party service providers may retain your Personal Information for as long as is necessary for them to comply with their legal and business obligations.

How We Protect Your Personal Information

We take reasonable and appropriate measures to protect your Personal Information from accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We implement commercially reasonable physical, administrative, and technical safeguards that are designed to protect the integrity and security of your Personal Information.

Unfortunately, no methods used to transmit Personal Information via the internet or methods of data storage are completely secure. Although we do our best to protect your Personal Information, we cannot guarantee that Personal Information may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or administrative safeguards.

The safety and security of your Personal Information also depends on you. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account. You should not share your password with anyone. When accessing your account from a public or shared computer, you should use particular caution so that others are not able to view or record your password or your other information. Please notify MSB Holdings immediately of any unauthorized access or use of the Site or the loss or unauthorized use of your account information (e.g., username or password).

Our Site may provide links to other websites for your convenience and information. These websites are not operated or controlled by us and may have their own privacy policies, which we strongly suggest you review if you visit any linked websites. We are not responsible for the content, privacy policies, or practices of any third parties. Where possible, we will warn you when you are leaving our Site and connecting to a site operated by a third party.

Our Policy on Children’s Information and Geographic Restriction

Our Site is intended for individuals who are 18 years of age or older. MSB Holdings does not knowingly request information from anyone under the age of 18. Any person who provides their information through the Site represents that they are 18 years of age or older.

MSB Holdings is concerned about the safety and privacy of children online. Because of this, we comply with the Children’s Online Privacy Protection Act of 1998 (“COPPA”). COPPA and its accompanying FTC regulations establish United States federal law that protects the privacy of children using the internet. As our Site is intended only for adults, we do not and will not knowingly contact or collect Personal Information from children under 13. Our Site is not intended to solicit information of any kind from children under 13, and we will develop our Site with the capacity to block acceptance of information from children under 13 whenever age-related information is requested.

However, we note that it is possible that by fraud or deception by others we may receive Personal Information given to us by or pertaining to children under 13. If you believe the information of anyone under the age of 13 has been provided to MSB Holdings, and you are the parent or guardian of that individual, you may contact us to request that we delete any such information, at customercare@rugiet.com.

Our Site is intended to comply with the laws and regulations of the United States of America. We make no representations that our Site is appropriate or available for use in any location outside of the United States. If you are a resident of another country, or are accessing the Site from outside of the United States, please note that you are transferring your personal data to the United States of America which does not have the same data protection laws as the European Union and other regions.

Email Communication

When you provide us with your email address, we may provide you with marketing and other promotional or educational materials. You may opt-out from receiving email communications at any time by emailing customercare@rugiet.com.

SMS Information

Data obtained through our SMS program will not be shared with any third-parties for their own marketing reasons/purposes. We may send you a text message via SMS or text, as well as phone calls and auto-dialed calls, when you opt-in or consent to receiving those messages. Such SMS or text messages, phone calls, auto-dialed calls, may include marketing and other promotional messages, as well as transactional messages. We may disclose your SMS or text message opt-in or consent data with our service providers that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. If you would like to stop receiving text messages from MSB Holdings at any time, please reply STOP or contact us at customercare@rugiet.com. After you send the message “STOP” to us, you will receive a message to confirm that you have been unsubscribed. Your Choices Your use of our Site and Services is voluntary

We offer you certain choices about how your Personal Information is collected, used, and shared, from deleting or correcting Personal Information you include in your profile to advertising opt-outs and communication controls. You can review and change your preferences by logging into your account or accessing our cookie preferences center. You may also update your preferences, remove your Personal Information, or deactivate your account at any time.

This Notice of Collection Of Personal Information and Privacy Policy (“CCPA Privacy Notice”) applies to the collection of personal information from California residents on and after January 1, 2020. This CCPA Privacy Notice supplements our “Privacy Policy” above to provide California residents with information and rights required by the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act (“CPRA”) (collectively “CCPA”). We do not collect sensitive personal information for purposes of inferring characteristics. MSB Holdings only collects and uses sensitive personal information concerning your health and sex life as necessary to perform the services or provide the goods the average person would reasonably expect when requesting those goods or services.

Retention Periods

We retain your personal information for the length of the customer relationship, plus the length of applicable statutory limitations periods, or as necessary to fulfill the purposes set out in this disclosure or as required by applicable law. Internet and geolocation data is generally retained for as long as one year.

Our Business Reasons For Collecting And Using Your Personal Information

Depending on the individual circumstances, we collect and use personal information for the legitimate business purposes of MSB Holdings. These purposes include to provide you with Services, to fulfill the purpose for which you provided us with your personal information, to communicate with you, to perform on a contract between you and MSB Holdings, to market or recommend our Services to you, to process payment and shipping and for account management, to improve the functionality and effectiveness of our Site, to protect the security of our Site, to protect against fraud, and to comply with applicable law, rules or regulations.

MSB Holdings collects Personal Information from the following categories of sources:

  • Service providers providing services on our behalf. We require our service providers who we provide your personal information to in order to provide services to maintain the privacy and security of your personal information.

Who Do We Disclose or Share Your Personal Information With

We do not sell your personal information to third parties.

We do share your personal information with third party advertising vendors for cross-contextual behavioral advertising purposes. We use information collected from cookies and tracking technologies (e.g., pixels, web beacons) in order to improve and customize your browsing experience, for analytics and metrics about your visits to our Site (e.g. the information concerning the length of your visit to our Site, where your visit originated from, what webpages on our Site you visited) and for marketing our Services to you. Other cookies are necessary for the Site to function properly or enhance the Site’s performance and functionality.

Third party advertising vendors use cookies and other technologies to serve ads based on your visits to the Site. Those third party cookies enable those advertisers to serve ads to our users based on previous visits to our Site and other sites on the Internet. These technologies are able to link your other Internet activity with activity on our Site for purposes of providing you with advertising that you may be interested in.

Your Rights Regarding Your Personal Information

  • You have the right to request that MSB Holdings disclose the personal information that MSB Holdings collects, uses and discloses about you. You may “request to know”: (i) the categories of personal information that MSB Holdings has collected about you; (ii) the categories of sources from which the personal information is collected; (iii) the business or commercial purpose for collecting or sharing your personal information; (iv) whether any categories of personal information were disclosed for a business purpose to third parties and the categories of third parties with whom MSB Holdings discloses your Personal Information; and (v) the specific pieces of personal information that MSB Holdings has collected about you. Your request may pertain to the personal information collected about you on or after January 1, 2022. If your request covers a time period beyond twelve [12] months from the date of your request, MSB Holdings may deny your request as to that time period where it would be impossible for MSB Holdings to provide you with the information or involve disproportionate effort. MSB Holdings may deny your request to search for certain information under certain circumstances (e.g., where MSB Holdings retains the information solely for legal and compliance purposes).
  • You have the right under certain circumstances to receive specific pieces of your personal information in a format that is understandable, and to the extent technically feasible, in a structured, commonly used, machine readable format that allows you to transmit the information to another entity.
  • You have the right to correct inaccurate personal information.
  • You have the right to request deletion of personal information under certain circumstances. For example, we may not be required to delete personal information if we need to retain the information to complete the transaction for which the personal information was collected, perform on a contract with us, or to comply with a legal obligation.
